PHILADELPHIA, Pa. -- Auxilium Pharmaceuticals recently settled a lawsuit by a plaintiff who claimed the testosterone drug Testim casued him to suffer a stroke.
The settlement occurred on January 2, 2018, according to a docket entry in Philadelphia Court of Common Pleas, which is just a few weeks after Eli Lilly announced it would settle the lawsuits brought against its testosterone drug Axiron.
Eli Lilly reached a global settlement agreement on December 21, 2017, which effectively resolved the more than 400 product liability claims brought against it. By agreeing to settle, the pharmaceutical company also avoided a series of trials that were scheduled to begin early this year.
Eli Lilly's global settlement and Auxilium's settlement with plaintiff Robert Hoehl could be indicative of future testosterone case outcomes. In Common Pleas Court in Philadelphia alone, there are 17 more testosterone lawsuits scheduled for trial starting in June. In the multidistrict litigation consolidated in U.S. Federal Court in Chicago, there are over 6,000 testosterone lawsuits still pending.
Hoehl's lawsuit also came just a few months after a previous Testim lawsuit that resolved in favor of Auxilium on November 16, 2017. The jury ruled that Testim was not responsible for a heart attack suffered by plaintiff Steve Holtsclaw.
Following the verdict, the company said in a statement that Testim was safe and they would continue to vigorously defend it. Despite that, the company settled with Hoehl just two months later.
Details of the settlement have not been released, but compensation in testosterone lawsuit was expected to be significant.
What is Testim?
Testim is a testosterone replacement therapy drug that is manufactured by Auxilium Pharmaceuticals, a subsidiary of Endo International. It is a gel substance that is applied topically to the skin, through which the testosterone hormone is absorbed slowly into the body.
Testosterone replacement therapy is used to treat severe deficiency of the testosterone hormone in men, known as hypogonadism.
