Auxilium Decides to Settle with Plaintiff in Testim Lawsuit

PHILADELPHIA, Pa. -- Auxilium Pharmaceuticals recently settled a lawsuit by a plaintiff who claimed the testosterone drug Testim casued him to suffer a stroke.Auxilium Testim Lawsuit Settlement

The settlement occurred on January 2, 2018, according to a docket entry in Philadelphia Court of Common Pleas, which is just a few weeks after Eli Lilly announced it would settle the lawsuits brought against its testosterone drug Axiron.

Eli Lilly reached a global settlement agreement on December 21, 2017, which effectively resolved the more than 400 product liability claims brought against it. By agreeing to settle, the pharmaceutical company also avoided a series of trials that were scheduled to begin early this year.

Eli Lilly's global settlement and Auxilium's settlement with plaintiff Robert Hoehl could be indicative of future testosterone case outcomes. In Common Pleas Court in Philadelphia alone, there are 17 more testosterone lawsuits scheduled for trial starting in June. In the multidistrict litigation consolidated in U.S. Federal Court in Chicago, there are over 6,000 testosterone lawsuits still pending.

Hoehl's lawsuit also came just a few months after a previous Testim lawsuit that resolved in favor of Auxilium on November 16, 2017. The jury ruled that Testim was not responsible for a heart attack suffered by plaintiff Steve Holtsclaw.

Following the verdict, the company said in a statement that Testim was safe and they would continue to vigorously defend it. Despite that, the company settled with Hoehl just two months later.

Details of the settlement have not been released, but compensation in testosterone lawsuit was expected to be significant.

What is Testim?

Testim is a testosterone replacement therapy drug that is manufactured by Auxilium Pharmaceuticals, a subsidiary of Endo International. It is a gel substance that is applied topically to the skin, through which the testosterone hormone is absorbed slowly into the body.

Testosterone replacement therapy is used to treat severe deficiency of the testosterone hormone in men, known as hypogonadism. Lawsuits against TRT manufacturers accuse the companies of pushing the prescription of these drugs for men who lack this medical condition, and instead simply exhibit symptoms like fatigue and reduced strength, which are natural effects of aging.

Testosterone lawsuits, including Hoehl's, claim that the pharmaceutical companies fabricated a condition for these symptoms called 'Low T' as part of the marketing strategy for selling the drugs. Thus, the companies allegedly used deception in order to sell their products, while there was sufficient medical evidence indicating that drugs like Testim could cause serious injury to patients.

What are the Serious Side Effects of Testim?

Testosterone replacement therapy drugs, including Testim, have been linked to serious cardiovascular complications, such as:

  • Heart attack
  • Stroke
  • Pulmonary embolism
  • Deep vein thrombosis
  • Blood clots
  • Death

What are the Criteria for Filing a Testosterone Lawsuit?

The following criteria must be met in order to file a testosterone lawsuit:

  • Must have had one of the following injuries:
    • Heart attack
    • Myocardial infarction

    • Pulmonary embolism
    • Deep vein thrombosis
    • Cardiogenic embolism
    • Blindness caused by blood clot to the eye
    • Other injury caused by a blood clot
  • If injury occurred while patient was taking TRT, must have been taking TRT for at least one month when the injury occurred
  • If injury occurred after patient stopped taking TRT, must be no more than 30 days since discontinuation of TRT when injury occurred
