Can I Sue If I Was Bitten By A Dog In Mount Clemens?

Under Michigan law, a person injured by an attacking dog does have the legal right to be compensated for the harm suffered in the attack.

The owner or keeper of the dog is liable to the victim for the injuries resulting from the bite, which can include permanent scars, nerve damage, and even broken bones.

In addition to state liability laws, the county has its own dog bite ordinance. In Macomb County, if a dog attacks a person it is in violation of the local ordinance.

According to the county ordinance (35.242 – Sec. 2), all dogs are expected to be kept under restraint. Every owner must exercise proper care and control of his or her dog to prevent them from becoming a public nuisance. In addition, every vicious dog must be securely muzzled or caged whenever off the premises of its owner and shall not be allowed to go unconfined and unrestrained on his or her premises or run at large.

The ordinance also outlines penalties for owners who violates any part of the outlined ordinance, stating:

Any person who violates any portion of this chapter regarding animals and fowl is guilty of a misdemeanor, punishable by imprisonment in the county jail for a term not to exceed ninety (90) days or a fine not to exceed five hundred dollars ($500.00) or both, in the discretion of the court.

A violation of an ordinance is considered evidence of negligence in a Michigan civil lawsuit for a dog bite or attack.
