What is the Statue of Limitations for Wrongful Death Lawsuits?

The time limit for filing wrongful death lawsuits in Michigan depends on the type of case that caused the death.  There is no specific limitations period for wrongful death cases in general, but rather the time period for filing a suit is based upon the type of negligence, act, or accident that led to the death.

In cases invloving motor vehicle accidents involving automobiles, motorcycles, trucks, bicycles, and pedestrians, there is a three year deadline from the date of the accident to file a wrongful death lawsuit in Michian.

In general, wrongful death lawsuits relating to defective products must be filed within two years of the date of the event. The two year limitations period also applies to cases involving governmental liability and police misconduct cases.

For medical malpractice lawsuits and nursing home lawsuits, the suit must generally be filed within two years after the date of the negligence. This period may be extended up to five years after the malpractice but depends on matters relating to probate court proceedings. These laws are confusing so it is important that you contact an experienced wrongful death attorney as soon as possible after the death.
