Sec. 4-33. Barking or dangerous dogs.
(a) No person who owns, possesses, or harbors a dog shall fail to exercise proper care and control of the dog to prevent it from becoming a public nuisance. Excessive, continuous or untimely barking, molesting passersby, chasing vehicles, habitually attacking other domestic animals, trespassing upon school or park grounds, trespassing upon private property in such a manner as to damage property or straying beyond the premises of the owner unless under proper care and control of some person, shall be deemed to constitute a public nuisance. Any person who violates this subsection shall be responsible for a municipal civil infraction.
(b) No person shall own or harbor a vicious dog, defined as a dog which has bitten a person or domestic animal without molestation, or which, by its actions, gives indication that it is liable to bite any person or domestic animal. Whenever a dog is brought to the pound for having bitten a person, the animal control officer or other duly authorized officer may, if deemed necessary and advisable, and after holding such dog a sufficient length of time to meet the requirements of the health department for investigation, cause such dog to be destroyed as a vicious dog. Any person who violates this subsection shall be deemed guilty of a misdemeanor.

Sec. 4-37. Personal and property damage.
Every owner of a dog shall be liable for damages for any and all injuries to person or property that may be caused by such dog on any public highway or other public place, to be determined and collected in appropriate legal proceedings, in which proceedings any failure or refusal by such owner to comply with the requirements of this chapter shall constitute prima facie evidence of negligence.
