Our Burton, Michigan no-fault lawyers recently filed a lawsuit on behalf of a client injured in a Genesee County motorcycle accident. Our client was traveling North on Saginaw nearing the intersection of Brady in the City of Burton, when a car traveling North in the lane next to our client turned right in front of our client, causing his motorcycle to go down. Our client suffered various serious injuries in the accident.
Under Michigan’s no-fault law, a person injured in a biker accident involving a motor vehicle is entitled to payment of certain economic benefits. One major type of benefit available is payment of allowable expenses consisting of all reasonable charges incurred for reasonably necessary products, services, and accommodations for an injured person’s care, recovery, or rehabilitation.
Allowable expenses include, but are not limited to, medical expenses incurred for hospital visits, medical treatment rendered by physicians, physical therapy, medical appliances such as canes or crutches, and prescriptions.
Our client’s allowable expenses included hospital expenses, physical therapy expenses, expenses for crutches and a walker, and prescription expenses related to his broken ankle and dislocated collar bone he sustained in the accident. Medicare initially made payment of many of these expenses, but retracted such payments when they discovered the no-fault insurance company was properly responsible for these expenses. The no-fault insurer has failed to make payment of such expenses.
The no-fault lawsuit seeks damages for the medical expenses the insurance company has failed to pay. The lawsuit was filed in the Wayne County Circuit Court. No trial date has been set by the Court.
