Can I Sue If I Was Bitten By A Dog?

Under Michigan law, a person injured by an attacking dog has the legal right to be compensated for the harm suffered in the attack.

The owner or keeper of the dog is liable to the victim for the injuries resulting from the bite, which can include permanent scars, nerve damage, and even broken bones.

In addition to state liability laws, the county has its own dog bite ordinance. In the city of Flint, if a dog attacks a person, it is in violation of the local ordinance.

According to the city ordinance (Sec. 6.14-4), it’s unlawful for any owner to permit a domestic animal to run at large. Any dog found to be in violation of the article, is subject to immediate seizure and impoundment. A fine up to $500.00 plus costs shall be paid by a defendant who is found responsible for each such violation.

According to the article, “Violators shall also be subject to sanctions, remedies and procedures as set forth in article 6 of chapter 2 of this Code and Public Act No. 236 1961 (MCL 600.101 et seq.).”

If a violation occurs, it is considered evidence of negligence in a Michigan civil lawsuit for a dog bite or attack.  These cases seem compensation for the victim’s physical and psychological injuries caused by the attack.   Settlements also include payouts for medical bills and even future plastic surgery to repair scars.

Can I File A Flint Lead Poisoning Lawsuit?

The subject of several crises this past decade, Flint is largely recognized for its high crime rates and has repeatedly been ranked among the most dangerous cities in the United States. The city was under a state of financial emergency from 2002–2004 and again from 2011–2015. More recently, Flint is most widely recognized nationwide for lead contamination in its local water supply.

Since 2014, the city has faced a major public health emergency due to contamination in the local water supply that has affected thousands of residents, as well as an outbreak of Legionnaires’ disease due to tainted water. As a result, the contamination catastrophe was identified as the third-largest outbreak of Legionnaires’ disease recorded in U.S. history.

If you or a loved one has suffered lead poisoning, you can file a lawsuit. Our Flint lead poisoning lawyers have won the top settlements in Michigan over the last 20 years. Many cases have resulted in compensation to provide for the child over his or her lifetime, including a $390,000 settlement for a child who suffered lead poisoning from lead-based paint and dust hazards at a rental property in Flint.

Flint Lead Poisoning Statistics & Crisis Timeline

The harmful effects of lead exposure on children’s health are well-documented. They include cognitive deficiencies, increased antisocial behavior, lower educational attainment, and a host of problems affecting the brain, kidneys and liver.

Not all children in Michigan are tested for lead. Children who are enrolled in Medicaid are required to be tested at 12 and 24 months, or between 36 and 72 months if they have not been tested before then. Anyone else can be tested voluntarily, regardless of age. Testing tends to be concentrated in areas with a higher likelihood of exposure to lead poisoning, such as Flint.

In the year 2016, there were 157,892 children that tested positive for elevated blood lead levels in Michigan. That is a 20 percent increase from the previous year. In Flint, specifically, blood levels in children under the age of six were at 92.3 percent.

With so many negative effects, it is devastating for parents to watch as their children become sick from lead poisoning.

To better understand the events of this crisis, our lead poisoning lawyers have created the Flint Water Crisis Timeline Infographic. The timeline depicts the major events in chronological order, beginning from the change in the water supply until former Michigan Gov. Rick Snyder’s appearance before a congressional committee in March 2016.

What Are The Time Deadlines For Personal Injury Cases in Flint?

The statute of limitations for filing lawsuits in Michigan is different for specific case types.

Most personal injury cases have a three-year deadline for suing a negligent person or business. Cases involving medical malpractice and nursing home neglect have a two-year time limit for filing a lawsuit.

There are some exceptions to these general rules. These include cases for wrongful death, matters involving injuries to a minor, and lawsuits based upon insurance contracts and no-fault laws.

You should contact our Flint attorneys immediately to determine how much time you have to file your case. You may qualify for an extension of time depending on your particular facts. However, if you miss the deadline, your case will be lost forever.

Which Court do I File a Flint Personal Injury Lawsuit?

For cases with damages of greater than $25,000, personal injury lawsuits are filed in Genesee County Circuit Court.  When the damages that do not exceed $25,000, the case must be filed in 67th District Court.  Litigants are entitled to a trial by jury in all courthouses.

Cases involving civil rights — including police brutality and certain employment law  cases — can be filed in the United States District Court for the Eastern District of Michigan.
