Eli Lilly Settles Testosterone Lawsuits in Federal Court

Federal court records indicate that Eli Lilly reached a global settlement with plaintiffs on December 21, 2017, and in doing so, effectively resolved the hundreds of product liability claims. 

As of January 2018, there are over 6,000 federal lawsuits against various manufacturers of testosterone drugs that have been consolidated under a multidistrict litigation. The testosterone cases are currently in the bellwether trail phase, meaning that a few representative cases have been chosen to go to trial first.

Eli Lilly's bellwether trails were scheduled to begin last month, but have been vacated in light of the settlement agreement.

The decision to settle is significant because it may indicate similar outcomes from the various other pharmaceutical companies involved in these testosterone lawsuits.

Over the past several years, thousands of testosterone lawsuits have been filed. In June 2014, a judge ruled to consolidate the cases into Multidistrict Litigation in the Northern District of Illinois.

At its peak, the MDL included 7,513 testosterone lawsuits.

In the bellwether trial phase, AbbVie, manufacturer of Androgel, lost one case in October 2017. A man was awarded $140 million as compensation for suffering a heart attack due to the drug.

AbbVie initially lost another Androgel lawsuit at a price of $150 million, but the verdict was eventually overturned. A new trial was ordered because the jury had required AbbVie to pay punitive damages but no compensatory damages.

In both Androgel cases, the juries ruled that the way AbbVie marketed the drug had downplayed its serious risks.

Auxilium has also faced litigation over its testosterone drug, Testim. A November 2017 case was ruled in favor of the company, as Testim was not found to be responsible for the plaintiff's heart attack. However, in January 2018, Auxilium settled with a plaintiff that had suffered a stroke after taking Testim.

  • Must have used name-brand TRT only, no shots
