Our child injury attorneys recently settled a Detroit Public Schools injury lawsuit on behalf of our minor client. Our seven-year-old client was participating in an after school latchkey program in the school’s gymnasium when she burned her arm on an exposed hot water pipe.
Our client sustained injuries, including but not limited to, a second degree burn on the back side of her upper right arm. Her treatment included the application of cream and follow-up with her pediatrician. She was left with a residual scar of approximately 2-1/2 inches.
Burn injuries are classified as first degree, second degree, and third degree. First degree burns usually affect the outer layer of the skin. A second degree burn, the burn our client suffered, is one that penetrates the outer layer of skin and extends to the deeper layer known as the dermis. Pressure on a second degree burn tends to produce red blanches. With these types of burns, if deep enough, there is a risk that scars may be left.
A lawsuit was filed in Wayne County Circuit Court against the Defendant school system. The case settled for $15,000.00.
Schools are to provide a proper supervision and a safe environment to children that attend. The failure of a school to provide safe premises, the failure to keep the child away from dangerous items, and the failure to prevent the child from being injured does can give rise to a lawsuit and compensation for the child’s pain and suffering may be able to be collected.
