Androgel Lawsuits End In Million Dollar Verdicts Against AbbVie

The Androgel trials are part of a testosterone multidistrict litigation that was consolidated in the U.S. District Court in Chicago. Androgel was one of the first drugs to be tried during the bellwether trial phase, where a few representative cases are chosen to go to trial first.

The Androgel bellwether trials saw the first verdict in July 2017, which decided that AbbVie should pay $150 million in punitive damages. However, because the verdict did not include any compensatory damages, a judge later overturned it and ordered a new trial.

In October 2017, a second Androgel trial ended in a $140 million verdict to compensate a man who suffered a heart attack after using Androgel.

In both cases, the juries determined that AbbVie had downplayed the serious risks of using Androgel in marketing the drug.

The AbbVie losses occurred just months before another testosterone drug manufacturer, Eli Lilly, decided to settle the lawsuits brought against its drug, Axiron, rather than go to trial.

Eli Lilly announced in December 2017 that it had reached a global settlement agreement to resolve the more than 400 cases against Axiron.

Because the company agreed to settle, a judge allowed for the scheduled Axiron bellwether trial dates to be vacated. Thus, Eli Lilly has avoided two trials that were set to begin earlier this year.

The details of the Axiron settlement has not been released, but compensation in testosterone lawsuits was expected to be significant, as demonstrated by the Androgel verdicts.

What is Androgel?

Androgel is a testosterone replacement therapy drug used to treat a deficiency of the testosterone hormone in men, or hypogonadism.

TRT drugs help to remedy the reduced strength, energy, and sex drive that can be caused by the condition.

Androgel is applied topically to the skin, through which the hormone is then slowly absorbed into the body.

Various TRT drugs have been approved by the FDA for men who have a diagnosed deficiency of the hormone, but there is evidence that a significant number of TRT users have never had their testosterone levels checked.
