Legal Issues in the Case

The fault of the Defendant driver was not an issue in the case based upon the clear negligence. Because the Plaintiff was a vehicle passenger, there was no fault that could be imposed upon her. The main issues in the case were the nature and extent of her injuries, the degree of disability, and the amount of compensation that would fairly compensation her for her injuries.

What We Did to Win the Settlement

We filed a lawsuit and took the deposition testimony of the parties, family members, eyewitnesses, and the investigation police offer. We also obtained all of the medical records and took the deposition of her treating surgeon to determine the full extent and permanency of her injuries. We attended mediation and agreed to a settlement of $925,000 for her third-party auto negligence claim.

We also filed her claims for no-fault insurance benefits and those were ultimately paid by the provider. Although the accident was in 2009, our legal team is still assisting the client with her claims for family provided attendant care services and home modifications to make her residence handicapped accessible and to accommodate her current needs.
