Facts of the Case

The case arises out of a car vs. motorcycle collision that occurred on March 9, 2016, at approximately 1 p.m. in Leslie, Michigan, in Ingham County. The collision was investigated by the Ingham County Sheriff Department. Defendant was driving a car owned by her boyfriend when she struck Plaintiff who was riding his motorcycle. Defendant failed to yield the right of way to Plaintiff at the intersection of Kinneville Rd. and Main St. in Leslie, Michigan. Defendant admitted that she never saw Plaintiff before the collision.

Photographs of our client’s motorcycle showed the significant damage caused by the collision.

The insurance company for defendants, Everest National Insurance Company, failed and refused to respond to multiple retention letters and a lawsuit had to be filed. After a short period of litigation, the insurance company agreed to settle the case by paying their policy limits. The defendants had the minimum policy limits of $20,000.

We served the defendant’s with the lawsuit and immediately filed a lawsuit against defendant’s insurance carrier. A lawsuit was also required to be filed against our client’s insurance company for uninsured motorist coverage in the event that defendant’s insurance company denied insurance coverage to defendants.
