Our hospital negligence lawyers recently settled a wrongful death lawsuit filed on behalf of an elderly woman who fell out of her hospital bed during an admission. She was noted to be a high risk for falls and an order for bedrails was in place. However, the bedrails were not up and she fell out of bed and struck her head. She later died due to the head trauma.
The defense in the case argued that the woman suffered a fatal stroke prior to the fall. However, our experts established that this was not the case based upon radiology studies and other evidence. We we were able to prove that the fall contributed to the death. The case settled for $200,000 prior to a jury trial. The amount of damages was limited under Michigan medical malpractice caps.
