Additionally, if the injured person is partially at fault for the incident then a compensation payout can be reduced by the persons’ percentage of negligence.  For example, if a premises liability case is worth $100,000 and the plaintiff is 20% at fault, then a likely settlement will be $80,000 because of the reduction for the plaintiff’s own negligence.

How Long Soes it Take to Get a Settlement?

The time it takes to get a settlement also varies from case to case.  In cases involving serious or catastrophic injuries, the time frame is usually much longer than a case with lesser injuries. This is because it is important to fully understand the long term consequences of an injury and the need for future medical care before agreeing to a settlement amount.  Attorneys that rush to get quick settlements often do a disservice to their clients because the get low settlements.
