Rear-End Warren Car Accident Lawsuit Filed

Our Warren car accident lawyers recently filed a lawsuit on behalf of a 26-year-old man who suffered serious injuries in a rear-end collision.  The accident occurred on Mound Road in Warren, MI.  Our client was stopped at a red light when he was rear-ended by a cement mixer truck.  The driver of the cement mixer was cited for failure to yield by the police.

Michigan law provides a special rule for dealing with rear-end accidents.  MCL §257.402 provides that drivers who hit the rear end of a car “shall be deemed prima facie guilty of negligence.”   That means that Michigan law creates a presumption that the person who hit the rear end of another car is at fault for the accident and guilty of negligence.  This presumption can be rebutted by other testimony or evidence that would justify hitting the rear end of the car, for example, testimony that the accident occurred at night and that the car that was hit did not having working tail lights.

Serious injuries were suffered to our client as a result of the Warren auto accident. His injuries included a bulging and herniated disc in his neck, and bulging discs at two levels of his lower back.  He has received months of physical therapy and chiropractic treatment, which is on-going.  He has been disabled from his job as a machine operator since the accident and has required attendant care and on-going household services.
