We recently settled a claim for underinsurance motorists benefits against Pioneer State Mutual Insurance Company. Our client was a pedestrian who was run over by a car in Mancelona, Michigan. Her leg was caught under a tire and she suffered significant injuries. These included an open wound on her leg, significant scarring and disfigurement, and nerve damage in her leg.
The insurance company for the negligent driver paid its full insurance policy limits of $20,000. We then filed a claim against our client's own insurance company, Pioneer State, under her underinsurance motorist benefit provision in her policy. Fortunately, she had purchased this coverage. We were then able to settle that claim for $80,000, making the total settlement $100,000.
