Motor Bike Lawsuit Filed For Pothole in Livonia

Michigan law provides that each governmental agency having jurisdiction over a highway shall maintain the highway in reasonable repair so that it is reasonably safe and convenient for public travel.   The person who sustains bodily injury or damage to his or her property by reason of failure of a governmental agency to keep a highway under its jurisdiction in reasonable repair and in a condition reasonably safe and fit for travel may recover the damages suffered by him or her from the governmental agency.

Due to the unsafe road condition, our client suffered several serious injuries including a fractured clavicle.  He required an open reduction surgery to repair the injury and was cleared to use his arm as tolerated five (5) months after the accident. He has chronic pain and has a residual scar from the surgery. There are also unpaid medical expenses which were incurred for treatment related to the accident.

The highway defect lawsuit seeks damage for the pain and suffering, disability, scarring, other personal injury damages, and unpaid medical expenses caused by the pothole. The case was filed in Wayne County Circuit Court in Detroit, Michigan.  No trial date has been set by the Court.
