He required an open reduction surgery to repair the injury and was cleared to use his arm as tolerated five (5) months after the accident. He has chronic pain and has a residual scar from the surgery. There are also unpaid medical expenses which were incurred for treatment related to the accident.
The highway defect lawsuit seeks damage for the pain and suffering, disability, scarring, other personal injury damages, and unpaid medical expenses caused by the pothole. The case was filed in Wayne County Circuit Court in Detroit, Michigan. No trial date has been set by the Court.
