Our Michigan medical malpractice lawyers recently filed a wrongful death lawsuit against an Ypsilanti, Michigan surgeon and a hospital for the death of a fifty-six year old woman. The lawsuit was brought on behalf of her son and daughter. It is currently pending in the Washtenaw County Circuit Court.
The patient travelled to Michigan from Ontario, Canada for a laparoscopic gastric bypass surgery. Despite have signs and symptoms of a post-operative leak, the surgeon and the facility discharged her home just twenty-four hours later. She became increasingly ill during the car ride home to Canada. After returning home, her daughter took her to a local hospital emergency department. Due to the significant sepsis and peritonitis, her condition continually declined and she passed away.
The wrongful death lawsuit alleges that the medical staff failed to identify the signs and symptoms of a gastric leak and improperly discharged her home. Had the condition been diagnosed or the discharged been delayed, surgery could have been performed to minimize the damage and prevent her death. No trial date has been set by the court.
