Our sidewalk injury lawyers in Michigan recently filed a lawsuit against the City of Detroit on behalf of a teenager who fell due to a defective public sidewalk. The fourteen year old boy was walking on a Detroit sidewalk and tripped on a raised portion of the sidewalk. He fell and suffered a broken arm which required casting. He is still seeing physicians for potential nerve damage in the arm.
Under Michigan law, a person injured from a broken sidewalk can make for injuries suffered due to a fall caused by this defective condition. A claim due to the city's failure to maintain the sidewalk can be made when the municipality violates required by Michigan Statute MCL 691.1401, et. seq. We filed a written claim providing notice to the City of Detroit on his behalf but did not receive any offer of settlement.
The lawsuit was filed in the Wayne County Circuit Court and seeks damages for the injuries, including pain and suffering. The suit also seeks reimbursement of medical expenses. No trial date has been set by the court.
