Michigan law provides a special rule for dealing with rear end accident. MCL 257.402 provides that drivers who hit the rear end of a car "shall be deemed prima facie guilty of negligence." That means that Michigan law creates a presumption that the person who hit the rear end of another car is at fault for the accident and guilty of negligence. MCL 257.402 also provides that all drivers must drive "at a careful and prudent speed, not greater than nor less than is reasonable and proper, having due regard to the traffic, surface, and width of the highway and of any other condition then existing.”
