Lake Orion Car Accident Settlement for Victim Rear Ended At Stop Light

Our Buckfire & Buckfire, P.C. lawyers recently settled a Lake Orion car accident lawsuit on behalf of a man who suffered serious injuries when the driver of the other car rear ended him while he was stopped at a stop light on Lapeer Rd. just west of Clarkston Road.  The negligent driver was issued a ticket for failing to stop in the assured clear distance.

Our client suffered serious injuries from the auto accident and has received continuous treatment for those injuries. His injuries included three herniated discs in the cervical spine; a concussion, left foot injury and abrasions and contusions.  He was hospitalized following the crash and later required surgical repair of his cervical spine.

The claim sought damages for the pain and suffering and disability caused to the victim rear-ended.  Once our expert attorneys got involved in the case, the representative handling the claim for the at fault driver’s insurance company agreed to a pre-suit settlement for full policy limits. We did not even have to file a lawsuit and our client was able to receive full compensation for their injuries.

Michigan law provides a special rule for dealing with rear end accidents. MCL 257.402 provides that drivers who hit the rear end of a car "shall be deemed prima facie guilty of negligence." That means that Michigan law creates a presumption that the person who hit the rear end of another car is at fault for the accident and guilty of negligence. This presumption can be rebutted by other testimony or evidence that would justify hitting the rear end of a car, for example, testimony that the accident occurred at night and the car that was hit did not have working taillights.
