Our dog bite attorney Robert J. Lantzy recently won a jury verdict in a CassCountydog bite lawsuit. The lawsuit was filed on behalf of a child who was attacked and bitten in the face by a neighbor’s dog when he was three years old. He suffered a significant scar on his face that was treated at the local emergency department. He was then taken to a plastic surgeon in Chicago for further treatment.
The lawsuit was filed in the Cass County Circuit Court. The suit sought damages for the boy, now age 10, for his past damages and future damages. Past damages included pain and suffering and his disfigurement for the seven preceding years. For damages into the future, additional claims were made for the disfigurement that he would have for the rest of his life. Additionally, claims were made for in excess of $10,000.00 for the future expense of plastic surgery to revise the facial scar.
The jury awarded a total of $90,000.00 for both past, present, and future damages. This includes the expense for the future plastic surgery procedures. The homeowner’s insurance company offered $50,000.00 to settle the case before the trial, but this was rejected. The award was $40,000 higher than the insurance company settlement offer.
