The lawsuit filed was for “Survivor’s Loss Benefits” under the Michigan No-Fault act.  The benefits under this provision of the no-fault insurance act are to the surviving dependents of the person killed.  The lawsuit is being filed for the replacement services and the dispute with the insurance carrier is whether or not the parents and sister of the person killed qualify as dependents under the Michigan No-Fault Act.  A section of the No-Fault act specifically states that “in all other cases, questions of dependency and the extent of dependency shall be determined in accordance with the facts as they exist at the time of death.”  Here, the pedestrian killed in the accident provided daily child care for her sister, so their parents could work.   Buckfire & Buckfire have filed a lawsuit maintaining that the younger sister was dependent on her older sister that was killed and both parents were as they could not afford child care and they needed to work.
