Our Michigan No Fault Insurance lawyers recently settled a case with Allstate Insurance for $55,000.00. The lawsuit sought payment of unpaid attendant care services and household services to our client who was injured in a Detroit car accident. Allstate Insurance wrongfully refused to pay her benefits.
Our client suffered serious injuries, including a right acetabular fracture requiring surgery, a subsequent separation of the hardware fixing the original acetabular fracture, and an ultimate removal of a portion of the right hip and inability to walk or function normally. Multiple hip surgeries and hip replacements that have failed as her body has rejected the hardware.
As a result of these serious injuries, she required attendant care services and replacement service benefits. Medicaid paid many of her insurance benefits and Allstate insurance was required to reimburse the government, but failed to do so. Additionally, our client could not handle many of her activities of daily living and needed assistance for others. Allstate refused to pay those benefits. We filed suit for her in the Federal Court in Detroit, Michigan. The case settled before trial.
