Our Michigan car accident lawyers recently filed a first party Michigan No-Fault Insurance lawsuit for a husband and wife in the Wayne County Circuit Court in Detroit, Michigan. The no-fault insurance lawsuit arises out of a 1991 auto accident in which the husband suffered catastrophic injuries, including a closed head injury. Due to his traumatic brain injury, the husband requires twenty-four hour attendant care services.
An attendant care benefit claim was made to the no-fault insurance company, Citizens Insurance. The insurance company has refused to pay these benefits as required under Michigan law. The lawsuit seeks payment of attendant care benefits provided to the husband by his wife. Citizens has paid a portion of those benefits, but has underpaid the properly hourly rate and for the correct number of hours. The lawsuit also seeks attorneys fees, costs, and penalty interest for the wrongful denial by the insurance company of these insurance claims.
