We often represent clients injured by dog bite and attacks. These often result in serious injuries and require medical treatment. We have obtained significant settlements for clients injured in these dog bite attacks.
Many cities and counties have ordinances regarding dogs and the responsibilities of dog owners. An owner or keeper of a dog who violates of these ordinances can be held liable for damages in a civil lawsuit to a dog bite victim. The ordinances can be used to prove a case in addition to other Michigan dog bite laws.
In St. Clair County, there are laws that apply to dog owners. These can be found in the St. Clair County Ordinances. Specifically, they are as follows:
Sec. 10-30. Running at-large prohibited.
(a) It shall be unlawful for any person owning, possessing or harboring any dog to allow or permit such dog to run at-large within the limits of the city. Dogs on a leash shall not be deemed to be running at-large.
(b) No owner of, or person harboring or keeping, a fierce or vicious dog, or a bitch in heat, shall allow such dog to run at-large at any time within the city limits.
(Code 1975, § 3-19)
Sec. 10-32. Dangerous dogs.
No person shall keep a dangerous dog within the city. "Dangerous dog" means:
(1) Any dog with a known propensity, tendency or disposition to attack unprovoked, to cause injury to, or to otherwise endanger the safety of humans or other domestic animals;
(2) Any dog which attacks a human or other domestic animal without provocation; or
(3) As otherwise defined by Act No. 426 of the Public Acts of Michigan of 1988 (MCL 287.301 et seq., MSA 12.545(21) et seq.), as amended.
(Code 1975, § 3-21)
Quite often, the victim of the attack files a report with either the local police or local Animal Control agency. When a report is filed, it is necessary to obtain report. Our firm routinely obtains these for our clients.
