Many cities and counties have ordinances regarding dogs and the responsibilities of dog owners. An owner or keeper of a dog who violates of these ordinances can be held liable for damages in a civil lawsuit to a dog bite victim. The ordinances can be used to prove a case in addition to other Michigan dog bite laws.
In Newago County, there are laws that apply to dog owners. These can be found in the Newago County Ordinances. Specifically, they are as follows:
Sec. 6-4. Running at large prohibited; exception.
No person shall permit any domestic animal or any goose, chicken, or other fowl to run or be at large in the public streets, lanes, alleys, vacant lots, or other open or public places; nor upon any private premises other than the premises of the owner or custodian of such domestic animal or fowl, without the consent of the owner or occupant of such private premises; provided, however, that any such domestic animal may be permitted on public properties if in the immediate control of a competent person and if in full compliance with the other provisions of this Code. The prohibitions of this section shall not apply to any horse carriage ride which is lawfully operating within the city pursuant to article IV of chapter 70 of this Code.
(Code 1980, ch. 103, § 9.52; Ord. No. 06-13, § 1, 8-14-2006)
Sec. 6-9. Vicious dogs.
(a) Generally. It shall be unlawful to keep, harbor, own, or in any way possess within the corporate limits of the city any vicious dog; provided that vicious dogs, kept within the city, upon the effective date of this addition to the ordinance may be kept if registered with the city clerk, and subject to that standards and requirements set forth in this division.
(b) Definition. For purposes hereof, "vicious dog" is defined to mean:
(1) Any dog with a propensity, tendency or disposition to attack, to cause injury or to otherwise endanger the safety of human beings or other domestic animals; or
(2) Any dog which attacks, attempts to attack, or which by its actions give indication that it is liable to attack a human being or other domestic animal.
Quite often, the victim of the attack files a report with either the local police or local Animal Control agency. When a report is filed, it is necessary to obtain report. Our firm routinely obtains these for our clients.
