Michigan Wrongful Death Lawsuit Settled For Fatal Auto Accident

Our Michigan auto accident attorneys recently settled a wrongful death lawsuit arising out of a tragic car crash in Wisconsin.  The collision involved our client who was a passenger in a car being driving by her husband. Her elderly father-in-law was also in the vehicle.  The Defendant failed to yield the right of way at a four-way stop colliding with our client’s vehicle.

Our client refused EMS care or treatment at the scene of the accident.  She did not go to the hospital or seek any other medical care on the day of the crash.  The next day she treated at a hospital in Wisconsin for slurred speech and was released after treatment. She later traveled with her husband back to Michigan where she began having symptoms consistent with a closed head injury.  Several MRI Scans were conducted; however, she later passed away from her injuries which included a brain bleed.

We filed a claim against the at-fault driver’s insurance company and settled the lawsuit pre-litigation for policy limits. The amount of the settlement was $250,000.00.

Wrongful Deaths Arising out of Fatal Car Accidents

After a fatal car accident, the family of the victim can file a lawsuit under the wrongful death statute.  Typically, this type of claim is brought by the family member of the person killed in the crash, however a guardian or another relative can also bring the claim.

In this type of lawsuit, the family of the decedent can sue the negligent driver and owner of the car for significant money damages, as often times in addition to the terrible loss of companionship, the death can also bring significant economic impact on the other family members.

While no amount of financial payment can ever compensate for the loss of a loved one, and during your grieving period consideration of a wrongful death lawsuit may not seem urgent, it is important when faced with such a tragic situation that an experienced auto accident attorney is contacted immediately.  The negligent driver will often deny fault and blame the victim for the collision.  As such, it is essential to start the investigation as soon as possible so that independent witnesses and evidence can be gathered to prove and win this case.
