Macomb County No-Fault Verdict
Many times it is very difficult to determine who is the proper insurance company for no-fault insurance claims arising out of an auto accident. There are many factors to consider, such as whether the injured person was driving a vehicle, was an occupant of a vehicle, was a pedestrian/bicyclist, or was riding a motorcycle, as well as whether the injured person was covered by a policy of no-fault insurance and whether the vehicle involved in the accident was insured.
One thing is certain, though. Any person (Michigan resident or not) who is injured in an accident in Michigan, either while riding in or being struck by an uninsured Michigan-registered vehicle, will be covered by no-fault benefits through the Michigan Assigned Claims Facility, if there is no other policy of no-fault insurance available to the injured person. Motorcyclists may also be eligible to receive no-fault insurance benefits through the Michigan Assigned Claims Facility if they have been involved in an accident with an uninsured motor vehicle (not another motorcycle).
WARNING: Benefits are not available from Assigned Claims to the owner (registrant) of an uninsured car or motorcycle who was injured in an accident while driving or occupying his or her own vehicle or motorcycle. Drivers of stolen cars or motorcycles are not eligible for benefits.
When an injured person is entitled to receive no-fault benefits through the Michigan Assigned Claims Facility, an Application for Bodily Injury Benefits must be submitted within one year of the date of the auto accident. The application must be submitted to:
Assigned Claims Facility
Michigan Department of State
Lansing, MI 48918-1412
517/322-1875 --- TTY 517/322-1477
E-mail address: AssignedClaims@michigan.gov
A claim submitted to the Assigned Claims Facility is screened by staff to make sure it meets the eligibility requirements. If so, it is assigned to one of nine Michigan insurance companies for complete investigation.
If the injured person is eligible for benefits, the assigned insurance company pays the claim. The Assigned Claims Facility does not pay claims.
The insurance company is then reimbursed by Assigned Claims Facility for the amount paid to the victim. Assigned Claims is funded by all companies who write auto insurance policies in Michigan and all self-insurers.

The insurance company refused to pay my benefits. Mr. Buckfire filed a lawsuit against them and made them pay every penny that they owed... Every time I see my doctor, I thank her again for the referral to Buckfire & Buckfire.

Because of his efforts, we proved that the other driver was at fault and the driver's insurance company paid a significant settlement for our injury claims... Hiring his firm to represent my son and myself was the best decision I could have possibly made. Many thanks for the great work.

My husband died when a truck left the roadway and struck him. He was off the shoulder of the roadway helping another motorist pull his car out of a snow bank The work that they did helped me settle my Michigan wrongful death case for $1,600,000.00. Their knowledge of law was second to none and they hired the best experts to prove my case.
