Many cities and counties have ordinances regarding dogs and the responsibilities of dog owners. An owner or keeper of a dog who violates of these ordinances can be held liable for damages in a civil lawsuit to a dog bite victim. The ordinances can be used to prove a case in addition to other Michigan dog bite laws.
In Melvindale, there are laws that apply to dog owners. These can be found in the Melvindale City Ordinances. Specifically, they are as follows:
Sec. 4-35. Report required.
If any person is bitten by a domestic animal, it shall be the duty of that person, or the owner or custodian of the animal having knowledge of same, to report same to the police department or animal control officer within 12 hours thereafter. If the owner or custodian of any domestic animal has any reason to believe or suspect that such animal has become infected with rabies, it shall be the duty of that person to report the same to the police department or to the animal control officer within 12 hours thereafter.
(Ord. No. 418, § 7, 4-21-76)
Sec. 4-37. Vicious dogs prohibited.
It shall be unlawful for any person within the city to permit a vicious, fierce or dangerous dog to go unconfined and unrestrained on such person's premises, or to run at large.
(Ord. No. 418, § 7, 4-21-76)
Sec. 4-48. Damages.
All persons shall be liable for damages for any and all injuries to persons or property that may be caused by any domestic animal owned by them, which damages may be determined and collected in appropriate civil proceedings therefore, in which proceedings the proof of the failure or refusal by such owner to comply with the provisions of this article shall constitute prima facie evidence of negligence on the part of such owners.
(Ord. No. 418, § 7, 4-21-76)
