Auto-Owners Lawsuit Filed in Michigan For No-Fault Insurance Benefits


Our Michigan car accident lawyers recently filed a Michigan No-Fault lawsuit for a client in the Wayne County Circuit Court in Detroit, Michigan. The case arises out of an rear-end car accident that occurred in the City of Flint on March 19, 2010. The client was a driver of a motor vehicle struck by a negligent driver who failed to see that our client was at a stop.
The client established a Michigan No-Fault insurance claim through her auto insurance carrier, Auto-Owners Insurance Company. Auto-Owners initially paid many of her benefits; but then failed to reimburse the client for medical expenses; mileage expenses and replacement household services. The client suffered a herniated disc in her neck; shoulder tear; TMJ; and underwent arthroscopic surgery for her shoulder and was entitled to these insurance benefits

Types of Michigan No-Fault Insurance Benefits

There are several different types of Michigan no-fault insurance benefits you are entitled to receive after suffering injuries in a Michigan car accident. Some of these include:
  • Attendant Care Services – Payment of benefits to have an agency or family member provide skilled or unskilled care and supervision to the accident victim during the period of recovery.
  • Medical Bills, Prescription Costs, and Expenses Benefits – Payment of lifetime medical expenses, doctor bills, rehabilitation expenses, and prescription expenses for injuries or aggravated in a car accident.
  • Wage and Income Loss Benefits – Payment of wages and income for accident victims who are unable to return to their employment due to injuries suffered in motor vehicle accident.
  • Survivor’s Loss Benefits – Payment of benefits, including funeral expenses, lost wages, and other to family members of an individual who dies in a motor vehicle accident.
  • Medical Mileage Expense Benefits – Payment for travel expenses to and from medical appointments, hospital visits, and physical therapy appointments.

Michigan No-Fault Insurance Lawyers Filing Lawsuit Against Auto-Owners

The failure and refusal to pay these insurance benefits violates the Michigan No-Fault Insurance statute. The claims were timely submitted and stem from car accident related injuries. The lawsuit seeks payment of all unpaid insurance benefits and in addition seeks payment of attorney’s fees, penalty interest, and costs for filing the suit. Auto-Owner’s Insurance will be responsible for significant payments if there is a determination that the failure to pay was unreasonable or unlawful. A trial by jury has been demanded to hear this lawsuit. The trial court has not yet set a date for trial.
