Many cities and counties have ordinances regarding dogs and the responsibilities of dog owners. An owner or keeper of a dog who violates of these ordinances can be held liable for damages in a civil lawsuit to a dog bite victim. The ordinances can be used to prove a case in addition to other Michigan dog bite laws.
In Flat Rock, there are laws that apply to dog owners. These can be found in the Flat Rock City Ordinances. Specifically, they are as follows:
Sec. 14-33. Liability for damages.
Every owner of a dog shall be liable for damages for any and all injuries to persons or property that may be caused by such dog on any such public highway or other public place, to be determined and collected in appropriate legal proceedings therefore, in which proceedings any failure or refusal by such owner to comply with the requirements of this article shall constitute prima facie evidence of negligence.
(Code 1979, § 9.104)
Sec. 14-43. Barking; running at large.
No person shall harbor or keep any dog which by loud and frequent or habitual barking, yelping, or howling shall cause serious annoyance to the neighborhood or to people passing to and fro upon the streets. No owner of or person harboring or keeping any dog shall suffer the same to run at large at any time within the city limits. Any person allowing any dog habitually to remain and be lodged or fed within his house, store, building, enclosure or premises shall be considered as harboring or keeping the same within the meaning of this article.
(Code 1979, § 9.113)
