Can a passenger injured in a Michigan motorcycle accident file a lawsuit?

An injured motorcycle passenger has the right to pursue claims for injury damages against the person responsible for causing the accident.   This would include an injury claim against a negligent motorist or truck driver who caused the accident with the motorcycle or with another biker who was responsible for causing the accident.  Either way, a claim for personal injury damages can be filed against the party that was operating the vehicle or motorcycle in a negligent manner and caused the accident.

The passenger may also be able file a claim against the rider of the motorcycle that the passenger is riding on at the time of the accident.  If this rider was careless in the operation of the bike and caused the accident, thereby injuring the passenger, a claim can be made against that person.  Although this may present an uncomfortable scenario for the passenger, it will be the rider’s insurance company that will pay the settlement.
