State Farm Attendant Care Lawsuit Filed By Michigan No-Fault Lawyer

Comments (0)

Our Ira Township car accident lawyers at Buckfire & Buckfire, P.C. recently filed a 1st party Michigan No-Fault lawsuit for a client in the Wayne County Circuit Court.  The case arises out of a head-on collision accident that occurred in Ira Township, Saint Clair County.  The client was a driver of a vehicle that went left of center and was involved in a head on collision with another motor vehicle. Even though the client appears to be at fault for the accident, he is entitled to his no-fault benefits.  Our client’s vehicle was insured with State Farm Mutual Insurance Company and he is seeking claims against State Farm.

Our client suffered serious injuries which include a traumatic brain injury and a fractured ankle requiring open reduction internal fixation surgery, as well as fractures to the rib, left quadriceps injury, and chronic low back pain.

The No Fault lawsuit seeks damages against State Farm for delaying benefits for replacement household services and attendant care benefits.  According to State Farm, they have placed those benefits “under investigation” which on many occasions is a delay tactic.

Attendant Care services commonly include, but are not limited to: preparing meals and feeding; assistance with personal hygiene, such as dressing and bathing; attending to wounds; assistance with medication; providing transportation to and from medical appointments; and supervision and monitoring, etc. Once it is established that a person requires and is provided attendant care, the insurer is obligated to pay for the attendant care. In addition, household services include tasks around your home that you used to do but cannot due to the injuries from the Michigan car accident.
