Dearborn Boy Drowns in Kalihari Water Park in Ohio

Ohio police report that a three year old Dearborn boy drowned at the Kalihari Water Park in Sandusky, Ohio.  Authorities are still investigating the incident.  My thoughts and prayers go out to his family. 

As a parent who has taken his children to a number of water parks before, I know how chaotic these facilities can be.  With the large number of children, the noise, and the total chaos, it is a stressful experience for any parent.  It is extremely important that the water park management have all possible safety precautions in place and proper lifeguarding at the pools.  The lifeguards must be able to constantly scan the waters for swimmers who go under the water or may be in distress. 

The failure to have necessary safety precautions in place can give rise to a water park accident lawsuit.  If the facility was negligent and a child is injured or drowns, the water park may be liable to the victim or the family for monetary compensation.  An experienced water park accident attorney will obtain all of the records and interview witnesses to see if the facility was at fault for a tragic accident, like this one.

Spring Lake Township Boat Accident Tragedy

A Michigan boat accident in Spring Lake Township has claimed the life of a Fruitport man.  This tragic accident occurred last night when another boater apparently crashed into his boat, ejecting him from the boat into the water.  Police have been unable to locate him and he is presumed to have died.  Another Fruitport man was injured and was taken to the hospital.  The boater who caused the accident was taken to jail.

I have written several articles on boating accidents in Michigan and this accident is an example on how careless and reckless boating can result in serious injuries and death.  While so many boaters follow the rules of the water and act safely, a few others with poor judgment cause terrible accidents.  The injured boater and the family of the missing boater should definitely contact an experienced Michigan boat accident lawyer to seek compensation for this accident.

Michigan Boating Accident Death | Boat Accident Lawyers

JI read a tragic story about a Marquette teenager who did Sunday in a Michigan boat accident.  Police are not releasing details as the matter is still under investigation, but reports indicate that the State Police responded to the scene of an overturned boat after midnight.  They do believe that alcohol may be a factor.

Boat Accident Deaths in Michigan

Boaters in Michigan are heading into prime Michigan boating season.  With the July 4th holiday quickly approaching, the Michigan lakes, rivers, and ponds will be full of boaters.  While boating is great recreational fun, we need to be reminded of the serious risks of injuries associated with this great sport.

A National Transporation Safety Board report demonstrates the substantial risks of boating accident deaths.  In 2007, over 7,100 boaters died and most of these were on small personal boats.  The majority of these deaths were due to drowning, and more than 90% of drowning victims would have lived had they been wearing a life jacket.  Other deaths were mainly due to boat operator negligence.

Boat operators and owners need to take all necessary precautions to protect their own safety and the safety of other boaters, jet skiers, and swimmers.  They also need to protect guests and passengers on their own boats who may not be aware of the substantial risks posed by boating and drowining accidents.  This can help insure a fun and safe summer on Michigan waters.

Golf Cart Accident Lawsuit Filed

Our firm recently filed a Michigan golf cart accident lawsuit in the Allegan County Circuit Court on behalf of our client who suffered serious injuries when she was struck by a golf car in a Michigan resort community.  The woman was a pedestrian walking in the community when she was struck by a golf cart driven by a teenager, who was driving a golf cart owned by his family.  The woman suffered serious injuries to her neck and back which required surgery.

Michigan Student Drowns In School Swimming Pool

A tragic drowning death occurred at the Michigan Career and Technical Center when 19 year old student William Beals died after being pulled out of an indoor pool.  The school is located in Prairieville Township, Michigan. Full details have not be released but reports indicate that he pulled out of the swimming pool by a lifeguard and other students and attempts to rescusitate him were unsuccessful.  An autopsy confirmed that his cause of death was drowning.

These types of swimming pool injuries and deaths should never occur, especially in a school swimming pool with a lifeguard.   Proper supervision was required and it was necessary to come to the student's aide before he drowned.  Lifeguards are trained to constantly scan the water for swimmers in peril, especially because most drowning victims do not splash or make noise.  I am not sure about the specifics in this instance, but quite often there are not enough lifeguards for the number of swimmers and they are not properly positioned on the deck to observe the pool.

The family of the decedent has legal rights and can consider filing a Michigan Wrongful Death Lawsuit.  The ultimate success of the case will be determined by the specific facts and the accounts of witnesses at the pool.  It is important that the family choose an experienced swimming poool accident and injury lawyer for their case because these matters are highly specialized and require a lawyer with that specific expertise.

ATV Accidents & Michigan No-Fault Insurance

Off-road vehicle (ORV) and ATV owners should be aware of an important change in the law that affects the rights of those injured in ORV accidents.   The Michigan law on off-road vehicles, like ATVs, was changed on July 17, 2008 as it relates to Michigan No-Fault Insurance Benefits.  The change in the law now excludes no-fault insurance benefits to injury victims in Off Road Vehicles unless the specific vehicle is registered for use on a public highway and has in effect the security provided by Michigan statute, MCL 500.3101(1) and other provisions.

With the exclusion of ORVs from the definition of motor vehicles through 2008 PA 241, ORV drivers and occupants will not be entitled to no-fault benefits for losses based on a single ORV accident or based on an accident in which two ORVs strike one another unless the ORV is licensed and has no-fault coverage under MCL 500.3101(1) or motorcycle coverage under MCL 500.3103. If an unlicensed and uninsured ORV is involved in an accident with a motor vehicle, the operator and occupants will be entitled to no-fault benefits in the same manner as a pedestrian, as a nonoccupant of the motor vehicle

The change in this law greatly affects those injured in ATV accidents.  Prior to the change in the law, those accident victims could claim No-Fault insurance benefits which include medical expenses, lost wages, attendant care benefits, and other benefits.  For questions about a specific ATV accident, you should contact a lawyer at our office immediately.

Snowmobile Accidents in Michigan

The first snow pounding of the year in Michigan is great news for outdoorsman and Winter sport participants in Michigan.  The most popular outdoor sports this time of year are snow skiing and snowmobiling.  Both are great fun but also can involve sustantial risks of serious injuries.  Persons injured in a Michigan Sports and Recreational Accident do have legal rights.

Lake St. Clair Boat Accident Tragedy

Tragedy struck the lakes Saturday night with this years first fatal Michigan boating accident. Three boaters were killed and two others were seriously injured when their boat  crashed into a dock at Belevdere Bay.  Police are still investigating the cause of the accident.  The number of Michigan  boating deaths seems to rise every year.  Although alcohol is frequently a factor, there have been no reports confirming that is was a factor in this accident.  There are boating regulations and laws of the lakes, just as there are the "rules of the road" for driving on our highways. 

Boaters and their passengers who are injured in accidents have legal rights to sue a negligent boater for their injuries.  Family members of boaters who have died can often bring a Michigan Wrongful Death lawsuit.  Although the police have not determined fault in this case, it is most common that driver error is the reason for a one boat accident.  As a result, the injured  passengers and their families can most likely pursue a civil case against the owner and driver of the boat.

Michigan Jet Ski Accidents

The number of jet skis and other personal watercrafts on the Michigan lakes this summer is on the rise.  Unfortunately, these increased numbers also mean an increase in the number of serious jet ski accidents in Michigan. 

A serious jet ski accident was reported yesterday in which a 25 year old Addison man, Kyle Hinkle was injured while jet skiing on Devils Lake with two friends.  He was airlifted to UM Hospital in Ann Arbor with a suspected spinal cord injury. 

This tragic accident highlights the need for increased safety awareness on our lakes and a bigger understanding by the public of the potential for serious accidents on the water.  It seems as though boaters, jet skiers, and others do not appreciate the same dangers on the water as they would on an open Michigan highway.  The injuries from Michigan boat accidents, jet ski accidents, and water ski accidents are often catastrophic and deadly.  The lakes provide great summer fun in Michigan but safety should always be the highest priority.
