Lake Michigan Boating Accident

A Lake Michigan boating accident near Ludington, Michigan has resulted in serious injuries to two Michigan boaters.  Police reort that Russel Valentine and Randy Culver sustained their injuries after their boat struck a concrete pier close to the Ludington Lighthouse.  Alcohol is not believed to be a factor in the crash.

I have written about a number of Michigan boat accidents this summer and rights of injured boaters.  The two men may have a claim against the owner of the pier if it was not properly marked on the night of the incident.  The injured passenger may also have claim against the boat driver for compensation for his injuries.  Although they may be friends, these types of cases usually result in settlements from the boat owners insurance company.

West Michigan Golf Car Accident Lawsuit Settles

Canton Car Accident

Canton car accident has resulted in the death of a Canton Township man.  Joginder Singh was killed by a minivan on February 5, 2009 following an accident on Ford Road near Sheldon Road.  The accident occurred at about 6:30 a.m. while it was still dark out as Joginder Singh was crossing Ford Road.  Even though two nurses witnessed the accident and immediately attempted to give aid, he could not be saved.  He was pronounced dead that day at St. Joseph Hospital in Ann Arbor.

I am very sorry this accident occurred.  I want to express my sympathies to this man's family and friends.

In an accident like this, Joginder Singh's family should submit a claim for Michigan No Fault benefits.  A No Fault survivor loss claim would provide them with money for the funeral and payments for loss of financial support and loss of household services.  Many times, these benefits help stabilize a family who has just loss the primary or even sole bread winner.

In addition to the No Fault claim, the family may want to consider filing a lawsuit against the driver that hit Joginder Singh.  This lawsuit would be for wrongful death, and it would seek additional damages beyond what No Fault insurance would cover.

Macomb County Car Accident Lawyers

A Macomb County car accident has resulted in the death of a pedestrian.  James Gilleylen, 52, was killed at about 6:30 a.m. on February 3, 2009 when a white car, possibly a Chrysler Neon, hit him at the intersection of Cass Avenue and Main Street.  A second vehicle, a grey or silver SUV, then hit him again before continuing on to an ATM.  Police believe that the drivers would have been aware that they hit something, even if they had not realized they hit a person.

I am very sorry when accidents like this occur.  I want to extend my sympathies to the family and friends of James Gilleylen.

When someone is killed in a hit and run car accident, the family of the accident victim should submit a claim for Michigan No Fault insurance survivor loss benefits.  A No Fault survivor loss claim can help the family deal with the economic costs of an unexpected death.  Survivor loss benefits include a payment for a portion of the funeral costs and payments for loss of financial support and loss of household services.  In addition, the family may be able to sue either the hit and run driver, or possibly their own insurance company for added benefits.

Detroit Pedestrian Loses Leg | Detroit Car Accident Lawyers

A pedestrian lost her leg in a Detroit hit and run car accident on February 1, 2009.  Jasmine Foreman, 30, had to have her leg amputated after being struck by a hit and run driver while crossing Michigan Avenue.  One of her cousin's said she rolled up over the hood of the car and onto the roof before being thrown off.  Police are still looking for the driver who hit her.  The car was a dark-colored Oldsmobile Alero that may have damage to its windshield.

I almost cannot believe someone would have such a disregard for human life as to drive off after hitting Jasmine Foreman.  If what her cousin said is true, there could be no mistake that the driver hit a person.  I hope the driver is found and prosecuted criminally.  I am very sorry for Jasmine and her family, and I hope her other injuries heal fully.

Although Michigan No Fault benefits will help most people who are injured in car accidents, they are especially beneficial to people who are severely injured.  Jasmine Foreman should submit a claim to her insurance as soon as possible.  Through her No Fault policy she will be able to collect payment for her medical expenses, including her hospital bills and follow-up for rehab and continued monitoring.  If she was working or unemployed but looking for work, she will be able to collect wage loss benefits.  She will also be able to collect household replacement services benefits and special transportation benefits because of her inability to operate a car due to her injury.  Her insurance company will even pay for her to hire a case manager to coordinate her different doctors' appointments and help her coordinate her insurance benefits.

In addition, to her claim for No Fault benefits, Jasmine Foreman may be able to file a lawsuit against the hit and run driver if the driver is ever identified.  This would be in addition to any criminal prosecution that the police or prosecutor's office might file.  Even if the driver is not identified, she may be able to file a claim for additional benefits through an insurance company if she or someone she lives with had uninsured motorist coverage.  She should discuss a possible lawsuit with a lawyer as soon as possible.

Upper Peninsula Car Accident Lawyers

An Upper Peninsula car accident has resulted in injuries to a pedestrian and may have been a hit and run accident.  The accident occurred on January 24, 2009 and was reported after a man was found lying in snowbank on a walkway near Cane Court Housing Complex in Ontonagon.  The man is believed to have been lying in the snowbank for up to several hours with injuries severe enough that they were likely caused by a car.  Police are still investigating the accident.

This is truly tragic.  It is hard to believe that someone would hit this man with their car and then leave him in freezing temperatures for several hours until a passerby found him.  I hope he is able to recovery fully from this accident.

When a pedestrian is hit by a car, the pedestrian can file a claim for Michigan No Fault benefits.  The No Fault insurance will pay for all reasonable medical expenses and a portion of the accident victim's lost wages.

In addition to the victim's No Fault claim, a pedestrian who is severely injured may be able to file a lawsuit against the driver.  If the hit and run driver is identified, the pedestrian may be able to sue the driver.  If the hit and run driver is never found or identified, the pedestrian may still be able to file a claim for similar damages if he has uninsured motorist coverage or through the Michigan Assigned Claims Facility.

Kalamazoo Hit and Run Car Accident

A Kalamazoo hit and run car accident has injured one man.  The accident occurred on December 10, 2008 near West Michigan Avenue and Kenbrooke Court at around 1:00am.  Police found a pedestrian who had suffered non-life-threatening injuries lying in a snow bank following the accident.  Police are still looking for the hit and run driver, who is believed to be driving a white midsize car that is missing a passenger side mirror.  Several large pieces of plastic were broken off its front bumper.

I am very sorry this accident occurred.  I hope this man is able to experience a full recovery.  The article makes it sound like his injuries are minor, but given the property damage to the car, the impact must have been very serious.

Even though the man that was injured was a pedestrian, he can still submit a claim through his car insurance for the injuries he has sustained in this accident.  If he submits a claim to his Michigan No Fault insurance company, the insurance will pay for all of his medical expenses including his current hospital bills and any reasonable and necessary follow-up treatment caused by the accident.  No Fault insurance will pay for a portion of his lost wages as well as other benefits depending on the severity of his injuries.

This man may be able to file a lawsuit against the hit and run driver for additional damages.  Michigan law allows only those who are very seriously injured to sue a negligent driver, so this man should speak with a lawyer about his injuries to see if he has a case.  If the man has uninsured motorist insurance coverage, he may be able to submit a claim to that insurance policy instead of suing the other driver.  Again, he should talk to a lawyer to determine if he should do this.

Tuscola County Car Accident

A Tuscola County car accident has resulted in the death of a woman.  The woman was struck by a car on Bray Road north of Willard Road in Arbela Township.  The accident occurred at about 6 pm on November 24, 2008 and there were several neighborhood witnesses. 

I am very sorry that this accident occurred.  The news report indicated that the woman was in her mid to late thirties when she died.  She should have had her whole life ahead of her.  My sympathies go out to her family for their loss.

In an accident like this, the family should probably do two things as soon as they reasonably can.  First, they should submit a claim for No Fault insurance survivor benefits.  This will provide them with a payment for part of the funeral.  It will also provide payments for loss of financial support and loss of household services, which are her wages or income and the value of household chores she performed, respectively.  Survivor loss benefits can provide near-immediate assistance to a family, especially one facing the loss of income of a working parent or of a homemaker who took care of the house so others did not have to.

The second thing the family should do is to speak with a lawyer about filing a lawsuit for wrongful death.  This could allow them to collect damages for their pain and for loss of companionship of this woman.  It would also allow them to collect damages beyond what is allowed by their No Fault company.  In fact, a lawyer can help assemble all the documents for a survivor loss claims as well to ensure they get all the benefits they are entitled to.
