Our medical negligence lawyers recently won a settlement for an eighty-two year old man who suffered serious injuries from a fall in a Michigan hospital. The patient had undergone an outpatient surgery under spinal anesthesia and was being monitored by the nursing staff in the post-anesthesia care unit. After a short period of time, he was instructed to get dressed by the nursing staff. He was not assisted by the nurse with dressing. When he stood up, his foot gave way and he fell to the floor. He suffered a fractured leg and a fractured shoulder, both of which required emergency surgery.
The patient fall in hospital lawsuit alleged that the nursing staff failed to properly monitor the patient in the recovery unit and that he should have been assisted with dressing. The suit also alleged that the patient did not fully recover from the effects of the spinal anesthesia and that his feet and lower extremities were still weak as a result and this was the reason that he fell and was injured. The hospital contended that the patient was properly monitored and that he had fully recovered from the anesthesia and could dress himself. The hospital also argued that the patient was instructed to call for assistance with standing but never did and therefore he was at fault himself for the fall.
The parties took numerous depositions of the nurses and other witnesses, including the patient’s wife and daughter. Depositions were also taken of nursing expert witnesses and an anesthesiology expert. Just prior to trial, the hospital agreed to pay a confidential settlement.
