Our Michigan nursing home lawyers recently filed a negligence lawsuit against the Glacier Hills Nursing Center in Ann Arbor, Michigan. The case seeks damages under the Michigan Wrongful Death Statute for the family of a resident who died from a fall from his wheelchair. He struck his head on the floor and suffered a brain injury. At the time of the incident, the nursing home resident was alone in his room and seated in his wheelchair. He apparently had fallen asleep and fell forward out of the chair and directly struck his head on the floor. He was rushed to the hospital but was not a surgical candidate.
The lawsuit alleges that the nursing home was negligent due to the failure to take appropriate measures to prevent this incident. The facility should have had a lap buddy belt or other restraint to keep him stable in his wheelchair if he was unsupervised. A simple solution would have been to place him in bed to rest after a long morning of physical therapy and put the bed rails up to prevent a fall. His family had consented to the use of bed rails as a fall prevention strategy.
The lawsuit seeks damages for the resident’s pain and suffering from the fall from wheelchair up until the time of his death. The suit also seeks damages for the loss of society and companionship suffered by his family as a result of his death, as well as medical expenses for his post-fall hospitalization. No trial date has been set by the court.
