Michigan Medical Malpractice Damage Limits Increase in 2013

Comments (0)

Medical malpractice within our medical system is quite common.  In fact, according to the Institute of Medicine of the National Academy of Sciences, nearly 90,000 people lose their lives annually in the hospital, resulting from a medical error.

At the law firm of Buckfire & Buckfire, P.C. our Michigan medical malpractice lawyers frequently file lawsuits for patients who suffered injury or harm due to a medical mistake performed by the hospital, doctor, surgeon, nurse, or any other medical professional.  These type of lawsuits seek fair compensation for the injuries suffered to the patient as a result of medical negligence. Unfortunately, these medical errors may often result in death to the patient, in which the family of the victim may be able to file a Michigan wrongful death lawsuit.

Often times, victims will ask how much compensation is recoverable for their injuries. Michigan law places caps, or damage limitations on the amount a medical malpractice victim can be awarded. This number changes every year to take into account for inflation.

In 2013, the lower damage limit is $455,200 and the higher damage limit is $774,000.  These caps do not include amounts that can be awarded for medical expenses, lost wages or earnings, and for loss of services.  These “economic” losses can be added to the damage cap limits.

Michigan law, MCL 600.1483, states these medical malpractice damage limits

Every case is different which means every settlement amount will also be different. If you believe that you or a family member has been the victim of medical malpractice in Michigan you may be able to file a lawsuit against the hospital or negligent medical provider that caused you harm. At Buckfire & Buckfire, P.C. our attorneys have had great success in handling medical malpractice cases throughout the entire State of Michigan. We will obtain and review all of the medical records and then discuss the care and treatment with a board-certified physician to determine whether there were mistakes and errors in treatment. When it is determined that a patient was injured due to a medical mistake, we file a lawsuit on behalf of the patient or the patient’s family. Call today at (800) 606-1717 to discover how we can help attain the best medical malpractice settlement for your case.
