Our Michigan slip and fall lawyers recently settled a lawsuit filed against the City of Detroit for a defective sidewalk. Our client, a twenty-six year old Detroit man, fell due to a rise of more than four inches on the public sidewalk and suffered a fractured foot. He did not require surgery for the injury.
A person injured in Michigan from this type of sidewalk defect can make a claim due to a city's failure to maintain the sidewalk as required by Michigan Statute MCL 691.1401, et. seq. Typically, there must be a two inch differential or drop off in the sidewalk in order to pursue such a claim. The lawsuit was filed in the Wayne County Circuit Court located in the City of Detroit. The parties engaged in depositions and other discovery. Upon completion of discovery, the City of Detroit agreed to pay our client a settlement in the amount of $25,000.00.
