Injured Michigan Motorcyclist No-Fault Benefits Lawsuit Filed

A Michigan no-fault insurance lawsuit was recently filed for a motorcyclist who was injured in an auto accident. The claim was filed against the auto insurer of the motor vehicle.  Our Buckfire & Buckfire, P.C. law firm was hired by the injured biker to help him attain the no-fault benefits he was rightfully entitled to, but unfortunately being denied.

The lawsuit around out of a collision that was caused when our motorcyclist client was cut off by a car that merged into his lane on Orchard Lake Road in Farmington Hills, Michigan.  The biker sustained injuries including a herniated disc at C-5, 6, herniated disc at L-4, 5, left L-5 radiculopathy  and coccygodynia.

Under Michigan’s no-fault act, a motorcyclist injured in a motor vehicle accident is entitled to a package of benefits from the insurer in priority that include payment of accident-related medical expenses; reimbursement of mileage traveled to and from medical appointments; payment of $20.00 per day for friends or family that undertake the injured person’s household chores while he/she is unable to perform them; and lost wages for the time the person is unable to work.

Due to the accident, our client incurred some medical expenses and medical mileage that went unpaid. Also, for a total period of approximately 4-½  months after the accident, our client’s wife provided household chores for which she was not paid by the insurance company.  Most significantly, our client was unable to work his full amount of hours as a school bus driver due to the pain in his low back and the insurance company refused to pay this wage loss.

Our motorcycle insurance attorneys filed the lawsuit in Oakland County Circuit Court in Pontiac, Michigan.  The parties attended the Court-ordered mediation and multiple settlement conferences.  After the second settlement conference, the insurance company agreed to pay $16,500.00, which fully compensated our client for the unpaid benefits.
