We recently obtained a brain injury settlement for a child who suffered a brain injury due to toxic exposure to lead. The child was poisoned at rental home in Flint, Michigan. The landlord's insurance company paid the confidential settlement.
Brain injuries can be caused by a number things, including trauma, infections, and toxic exposures. Many of these brain injuries are the result of negligence by either another person, like a car accident, or a business, like an apartment complex or recreational facility. Depending on the cause of a brain injury, the brain injury victim may have legal rights to compensation for his or her injuries.
It is essential that an experienced Michigan brain injury lawyer be contacted to discuss your case. Lawyers not familiar with brain injuries may simply not understand the nature of the injury or the impact that it has on the victim's life, as well as on the family of the victim. We recently settled a Michigan car accident lawsuit for a woman who suffered a closed head injury in the accident. Her vehicle was forced off the roadway by another driver and she struck her head in the accident. She was later diagnosed by a neurologist with a traumatic brain injury and underwent psychological counseling for her deficits. She missed substantial time from work and was unable to return to her pre-accident activities. The case was settled after a lawsuit was filed and the negligent driver's auto insurance company paid the settlement.

I attended a conference earlier this week on litigation strategies in traumatic brain injury cases in Michigan. A main topic was the difficulty in convincing juries that an accident victim suffered a brain injury or closed head injury and that the injury has altered their life or caused permanent damage. Jurors often seem skeptical about a brain injury when the victim was not unconscious after the accident, radiology films are normal (MRI, CT Scan), and the victim is not hospitalized for the injury. Many jurors incorrectly believe that a person must be in some type of lengthy coma to have suffered a serious brain injury.
The simple fact is that most jurors have never met anyone with a traumatic brain injury (TBI) and are deciding important issues based upon their own preconceived ideas as to what is necessary for a person to have a serious brain injury. Much of this comes from what they see on television or in the movies.
An experienced brain injury lawyer helps the jurors understand the truth behind brain injuries by presenting doctors and physicians to explain the mechanics of brain injuries and through medical illustrations and videos that depict how the brain is damaged due to a trauma. It is essential to choose a lawyer that has experience with representing brain injury victims because a thorough understanding of these injuries is necessary to prove and win a case at trial.

I recently came across an interesting Traumatic Brain Injury Fact Sheet on the National Center for Injury Prevention and Control section of the Center for Disease Control website. The Fact Sheet sets out the staggering number brain injuries in the United States every year and the cost of those injuries. A traumatic brain injury (TBI) is caused by a blow or jolt to the head or a penetrating head injury that disrupts the normal function of the brain. Not all blows or jolts to the head result in a TBI. The severity of a TBI may range from “mild,” i.e., a brief change in mental status or consciousness to “severe,” i.e., an extended period of unconsciousness or amnesia after the injury.
The CDC estimates that 1.4 million Americans suffer traumatic brain injuries every year. Of that total, the majority (1.1 million) are treated at emergency departments and released. Many of those individuals require substantial medical treatment and rehabilitation for years after their injury. About 235,000 of those individuals are hospitalized for their brain injuries and over 50,000 die from head injuries.
The costs for those injuries are substantial. One study estimates that medical costs and related costs, like lost work productivity, totaled $60 billion in 2004. Those numbers increase every year as medical costs rise. These are cold, hard numbers and do not account for the lives of the brain injury victims that have been interrupted and changed forever, or the toll that it takes on the families of brain injury survivors.
The traumatic brain injury lawyers at my law firm understand how the life a brain injury victim is changed and we have expertise in not only proving the extent of a brain injury in a lawsuit, but in explaining the effect that it has on a victim's life. With the help of the family members of the brain injury survivor, we are able to not only prove the extent of the physical injury but also the psychological aspects of the brain injury. This experience and our proven techniques help us achieve substantial settlements and verdicts for our brain injured clients.
The recent brain injury and death of actress Natasha Richardson is responsible for saving a young girl's life. Morgan McCracken, 7, was hit in the head by a softball by week. Although she felt fine immediately after her injury, she started complaining of a headache two days later. Her parents had heard about Natasha Richardson's death from a brain injury called epidural hemorrhage and rushed their daughter to the emergency room. Even though they acted quickly, Morgan still needed to be airlifted to another hospital for emergency surgery, even though it would have taken only 20 more minutes for her to arrive at this hospital by ambulance instead of helicopter. Fortunately, the doctors were able to perform the surgery successfully and Morgan McCracken will be fine.
Epidural hemorrhage is a particularly deadly brain injury because its victims feel fine for hours or even days after the initial injury. During this time, however, blood is seeping into the skull from torn blood vessels and eventually the pressure builds up to such a degree that blood begins to penetrate the brain. At this point, emergency surgery is required to avoid death or permanent brain damage. This injury is known as "talk and die" syndrome because, as with Morgan, even a 20 minute delay can be the difference between life and death.
When a person suffers from epidural hemorrhage, the victim or his or her family may be able to sue the person who caused the brain injury. Winning a lawsuit involving a brain injury requires a lawyer who knows both the law and the science behind traumatic brain injuries. The Michigan brain injury lawyers at Buckfire & Buckfire are experts in brain injury cases.
The Brain Injury Association of America (BIA) has designated March as Brain Injury Awareness Month. The organization builds public awareness regarding brain injuries and strives to change the public's attitude about brain injury victims. The BIA offers free downloadable resources for the public to use and special materials on Sports & Concussion Injuries.
Our Michigan brain injury lawyers have significant expertise in closed head injury cases. A closed head injury is a type of traumatic brain injury and occurs when there is no penetration of the skull. These can happen from blunt trauama or even from acceleration-deceleration, like the head thrust forward and backwards quickly. The results can be devasating and cause memory loss, other forms of brain dysfunction and even death. Because this is an invisible injury, many people simply do not understand the serious nature of a closed head injury.
Many insurance companies actually use this fact against brain injury victims and deny important insurance benefits for this reason. They go so far as to pay millions of dollars to hired gun medical experts who call brain injury victims fakers, exaggerators, and malingerers. Because the injury cannot be seen and most often does not even show up on an MRI or CT scan, the insurance doctors portray the brain injury victim as someone who either has no injury or some other type of condition, like depression unrelated to the accident. For this reason, it is essential that a closed head injury victim choose the best possible lawyer for his or her case.
The Michigan brain injury lawyers at Buckfire & Buckfire, P.C. have recently added an article on the brain injury epidural hemorrhage. The article explains this brain injury, which is known as "talk or die" syndrome.

The Michigan brain injury lawyers at Buckfire & Buckfire, P.C. have recently added an article on the brain injury aphasia to their online library. Aphasia is a common brain injury that occurs when the left side of the brain is deprived of oxygen. This causes damage to the parts of the brain responsible for language. While aphasia does not effect the intelligence of the people who suffer this brain damage, it limits their ability to communicate with others.
This article provides a description of aphasia, a list of common causes, and resources for those suffering from aphasia and their families.
When aphasia is caused by the negligence of another person, for example a nurse or doctor who misdiagnoses a stroke, or a negligent driver who causes a car accident, the person who suffers the injury may be able to file a lawsuit. This person or a family member should strongly consider contacting an experienced Michigan brain injury lawyer to discuss their possible case.
