An Oakland County, Michigan jury recenlty awarded a 62 year old woman a verdict for injuries that she suffered when she was being transferred from her wheelchair into her car. During the transfer, she fell and suffered a severe ankle injury which required surgery. The lawsuit was not filed as a medical malpractice case but rather as an ordinary negligence lawsuit.
The jury awarded the patient a total of $464,015.00. This included $250,000 for past noneconomic damages, like pain and suffering, and an additional $295,000 for future non-economic damages. This is compensation for her pain and suffering that will continue into the future. The jury found that the patient was 15% at fault for the incident and the total verdict was reduced by that amount. The hospital will not appeal.
