State Farm No-Fault Insurance Verdict in Michigan

A Michigan jury hammered State Farm Insurance Company for more than $700,000 in a Michigan No-Fault Insurance lawsuit.  This case was a classic example of the insurance company fraudulently refusing to pay claims to the victim of a serious auto accident and significantly underpaying claims that it did pay.  State Farm underpaid a family member for attendant care services and refused to pay a brain injury treatment center for medical services provided to the injured patient. 

As usual, the insurance company hired several doctors to perform medical examinations on the accident victim and give testimony that the injuries were not related to the accident and were not necessary.  These insurance company doctors make a fortune in fees from large insurance companies to terminate benefits for accident and injury victims.  The jury apparently saw these "bought and paid for" doctors for the frauds that they were and understood that the insurance company was unreasonable in refusing to make payments.

Attendant Care Benefits in Michigan

Attendant care benefits in Michigan are provided to car accident victims under the Michigan No-Fault law. These benefits are services provided to an injured person during their course of recovery and pay for the supervision, bathing, and caring for the accident victim. Although these services can be provided by an agency, they are frequently provided by family members of the accident victim.

The insurance company is required to pay the family member a resonable rate for the services, which can range from $10/hour to $22/hour depending on the level of care provided. Quite often, the insurance company intentionally underpays the family member or denies payment for no good reason. Our firm recently settled a claim against AAA insurance for $135,000 for this very reason.

Tuscola County Motorcycle Accident

I read a tragic story about four motorcyclists were injured yesteday in a  Tuscola County motorcycle accident .  Oakland County residents Cary Misenar and his passenger, Margaret Misenar, where on their Harley when a truck headed the opposite direction on M-46 crossed the center line and struck them. 

Another bike driven by Michael Newsome with passenger Becky Hutchings on also overturned while trying to avoid the accident.  Both motorcycle drivers and passengers were taken to the hospital for their injuries.

I wish all four injured bikers a fast recovery.  The injuries suffered in these accidents are often catastrophic and often seem to be the result of careless motorists who ignore the rights of bikers.

All of the injured bikers may be entitled to Michigan No-Fault Insurance Benefits for payment of medical expenses, lost wages, and other expenses.  Their entitlement will depend on a number of factors, including their insurance policies and the specific facts of the accident.  They may also have claims for their injuries and pain and suffering against the negligent motorist.

    A motorcycle driver was killed in a two-vehicle crash yesterday morning on a mountain highway west of Denver. The fatal crash happened when a woman driving a Kia Rio pulled out of Goddard Ranch Court to head southbound on U.S. 285 and "into the path" of the northbound motorcycle. The motorcycle driver, who was wearing a helmet, died at the scene.

    This was the second motorcycle accident in 24 hours; the first accident involved a single motorcycle running into a guardrail, leaving both people on the motorcycle dead. The crash occurred on the U.S. 34 West exit ramp near Greeley, late Sunday afternoon and forced the closure of the ramp for several hours.

    These sad events are reminders that motorcycle safety should be a constant concern for both motorcyclists and other drivers at all times. The Motorcycle Safety Foundation has many safety tips, including the following for drivers:

    Motorcyclists often slow by downshifting or merely rolling off the throttle, thus not activating the brake light. Allow more following distance, and do not depend upon the brake lights to indicate de-acceleration. A motorcyclist may slow down without visual warning.

    Because of its small size, a motorcycle may look farther away than it is. It may also be difficult to judge a motorcycle’s speed. When checking traffic to turn at an intersection or into (or out of) a driveway, predict a motorcycle is closer than it looks. And be aware that because of its small size, a motorcycle can be easily hidden in a car’s blind spots (door/roof pillars) or masked by objects or backgrounds outside a car (bushes, fences, bridges, etc). Take an extra moment to thoroughly check traffic, whether you're changing lanes or turning at intersections.

    There are a lot more cars and trucks than motorcycles on the road, and some drivers don't "recognize" a motorcycle, it just doesn’t register. Consciously look for motorcycles, especially when checking traffic at an intersection.
