Our Michigan nursing home lawyers recently settled a neglect case against a skilled nursing facility and the nursing home physician. The resident entered the facility for rehabilitation after surgery at a local hospital. Upon admission, an assessment was performed on his skin and it was noted that there were no skin lesions. He remained in the facility for twelve days and was discharged home.
Once home, he was evaluated by a visiting nurse who noted a Stage 3 bedsore on his sacrum. He was subsequently admitted to another hospital. Due to the severity of the condition, he required a colostomy surgery and had skin flap surgeries cover the wound. He has significant scarring as a result and is required to wear a colostomy bag.
A lawsuit was filed seeking compensation for nursing home neglect. After numerous depositions of nursing home personnel and expert witnesses, the case settled at mediation for $275,000.
